Move licensing of attorneys from Montana Supreme Court back to the Montana Legislature
The courts need checks and balances too and right now no other branch nor we the people have any checks against the courts power to license lawyers.
"We the People" have the right to "lobby" our senators and representatives and explain why a law should or should not be enacted but it is ILLEGAL to lobby a judge.
The Mt Supreme Courts requires lawyers to belong to the MT bar association in order to practice. State Bar Associations have been going after attorneys taking cases that the Bar deems inappropriate, such as defending grandma and her son who were in the Capitol Building on January 6. The bar associations file ethics violation charges against those attorneys and get them disbarred. When that happens, not only does the lawyer lose his ability to practice law, thus his livelihood, but you just lost your attorney to represent you in court.
This has a startling chilling effect when one's livelihood is threatened with no recourse. that means that if a lawyer senses your case against the government (think President Trump or the J6ers) is going to get them in trouble with their state bar association, they don't want to take your case.
In summary, the Supreme Court has usurped power from the people and practicing lawyers. That loss of freedom is a major reason why our court system leans hard left and why the government is embolden to defy the law and challenge “We the People” to take them to court if we don’t like what they did.
